Sahara Bikes Electric Bike Company (“Sahara Bikes”) agrees to sell electric bicycles (“E-bikes”) and/or other bike accessories to the Purchaser as reflected in the attached sales invoice. The Parties agree that the sale of E-bikes and/or accessories will be governed by this Contract of Sale, Waiver, and Release from Liability (“Agreement”). Use and Safety of E-bikes. The Purchaser acknowledges that Sahara Bikes cannot supervise or oversee the safety and proper usage of the E-bike(s) and accessories. As such, Sahara Bikes cannot be held responsible for the safe use or other actions of the Purchaser or future riders of the E-bikes. Compliance with Laws. The Purchaser, being at least 16 years of age, agrees to obey all federal, state, and local traffic laws and regulations, including all electric bicycle laws, when riding the E-bike(s). The Purchaser assumes all risks of riding the E-bike(s) and agrees to indemnify and hold Sahara Bikes harmless for any liability incurred as a result of the Purchaser’s failure to comply with such laws. Usage Restrictions. The Purchaser agrees that the E-bikes are intended for use by one rider only and are not designed or safe to be used to carry a second passenger. The Purchaser acknowledges that anyone with serious medical conditions should not ride an E-bike, and that no one should ride the E-bike while under the influence of alcohol or drugs, or while otherwise incapacitated. Refund Policy. If the Purchaser is not satisfied with the E-bike, they may return it within 14 days of receipt, subject to a $600 restocking fee. The E-bike must have less than 50 miles on the odometer, be free from any wear and tear, and must be in the same packaging and condition as when received, with all original components included. Riding in Hazardous Conditions. The Purchaser acknowledges that it is not safe to ride the E-bike(s) in hazardous conditions, including uneven or off-road terrain, significant rain, or in snow. The Purchaser agrees to maintain a speed of no more than 20 mph in conditions where their vision may be impaired, such as at night or at dusk/dawn with limited light. Risks and Liabilities. The Purchaser acknowledges that riding an E-bike is a dangerous activity that requires skill and experience, and that it may result in serious injury to the person or damage to property. The Purchaser voluntarily assumes any and all risks associated with the use of the E-bike(s). The Purchaser also agrees to only charge the battery using a regular wall outlet, and acknowledges that Sahara Bikes  is not responsible or liable for any damage caused by battery misuse or charging the battery in any other manner. Battery Charging and Maintenance. The Purchaser agrees to charge the battery every 1-2 months when not in use and acknowledges that water damage is not covered under the warranty. Bike should never be charging unattended General Provisions.
